accommodation clause
(Scope of application)
第1条
The accommodation contract and related agreements entered into by the hotel with the guest shall be in accordance with the provisions of these general terms and conditions, and any matters not provided for in these general terms and conditions shall be in accordance with laws and regulations or generally established customs.(2) Notwithstanding the preceding paragraph, if the hotel agrees to a special agreement that is not contrary to law or custom, such special agreement shall take precedence over the preceding paragraph.
(Application for accommodation contract)

A person who wishes to apply for an accommodation contract with this hotel is requested to provide the following information to this hotel.(1) Name of person staying
(2) Date of stay and estimated time of arrival
(3) Nightly rate (in principle, based on the basic room charge in Appendix 1)
(4) Other matters deemed necessary by the Museum
In the event that the guest requests to continue his/her stay beyond the date of stay as specified in item 2 of the preceding paragraph during his/her stay, the hotel shall treat such request as a new application for a contract of accommodation at the time such request is made.
(Formation of Accommodation Contract, etc.)

The accommodation contract shall be concluded when the hotel accepts the application as described in the preceding article. However, this shall not apply when the hotel proves that it did not give its consent.(2) When an accommodation contract has been concluded pursuant to the provisions of the preceding paragraph, an application fee determined by the hotel shall be paid by the date designated by the hotel within the limit of the basic accommodation charge for the period of stay (3 days if the period exceeds 3 days).
The deposit shall first be applied to the room charge ultimately payable by the guest, and in the event that the provisions of Articles 6 and 18 apply, the deposit shall be applied in the order of penalty followed by compensation, and any remaining amount shall be returned at the time of payment of the charges pursuant to Article 12.
In the event that the reservation deposit as stipulated in paragraph 2 is not paid by the date designated by the hotel pursuant to the same paragraph, the accommodation contract shall cease to be effective. However, this shall apply only in the event that this hotel has notified the guest to that effect when designating the date for payment of the application fee.
(Special clause that does not require the payment of an application fee)

Notwithstanding the provisions of Paragraph 2 of the preceding article, the hotel may accept a special agreement not to require the payment of the application fee under the same paragraph after the contract is concluded.In the event that the hotel does not request payment of the application fee as stipulated in Paragraph 2 of the preceding article or does not specify the date for payment of said application fee, the hotel will treat the application as having complied with the special agreement stipulated in the preceding paragraph.
(Refusal to enter into an accommodation agreement)

The hotel may refuse to conclude an accommodation contract in the following cases
(1) When the application for accommodation is not in accordance with these terms and conditions
(2) When there is no room available due to full occupancy.
(3) When it is recognized that the person seeking accommodation is likely to conduct himself/herself in a manner contrary to the provisions of law, public order, or good morals in connection with the accommodation.
(4) When it is recognized that the person who intends to stay falls under any of the following items (a) through (c).
a. Boryokudan (organized crime groups) as defined in Article 2, Paragraph 2 of the Law Concerning Prevention of Unjust Acts by Organized Crime Groups (Law No. 77, 1991) (hereinafter referred to as "Boryokudan") Boryokudanjin prescribed in Article 2, Item 6 of the same law (hereinafter referred to as "Boryokudanjin") Quasi-organized crime syndicate members or persons related to crime syndicates and other antisocial forces
b. Boryokudan or a juridical person or other organization whose business activities are controlled by Boryokudan or Boryokudan-involved persons
C. A juridical person of which any of its officers falls under the category of Bouryokudan-in (Boryokudan Member)
(5) When the person seeking accommodation says or does something that causes significant inconvenience to other guests
(6) When the person seeking accommodation is clearly recognized as a person with a contagious disease.
(7) When a violent demand is made with regard to the accommodation, or when a burden exceeding a reasonable range is demanded.
(8) When the hotel is unable to accommodate the guest due to a natural disaster, breakdown of facilities, or other unavoidable reasons.
(9) When a guest is drunk or otherwise likely to cause extreme inconvenience to other guests. (10) When a guest is extremely disturbing to other guests by his/her speech or behavior. (When a guest falls under the provisions of Article 10 of the Enforcement Ordinance of the Hyogo Prefecture Ryokan Law)
(Guest's right to cancel the contract)

The guest may cancel the accommodation contract by making a request to the hotel.In the event that the guest cancels all or part of the accommodation contract due to reasons attributable to the guest (except in the event that the hotel has designated the due date for payment of the application fee and requested payment thereof pursuant to Article 3, paragraph 2, and the guest has cancelled the accommodation contract prior to such payment), the hotel shall charge the guest a penalty fee as set forth in Appended Table 2 The hotel will charge a penalty fee in accordance with the provisions listed in Appended Table 2. However, in the event that this hotel has complied with the special contract stipulated in Article 4, Paragraph 1, it is only when this hotel has notified the guest of the obligation to pay the penalty charge when the guest cancels the accommodation contract in complying with such special contract.
If the guest does not arrive at the hotel by 20:00 on the day of stay (or two hours after the estimated time of arrival, if such time has been specified in advance) without informing the hotel, the hotel may deem the accommodation contract to have been cancelled by the guest and treat it as such.
(The museum's right to terminate the contract)

The hotel may cancel the accommodation contract in the following cases
(1) When it is recognized that the guest is likely to commit or has committed an act contrary to the provisions of laws and regulations, public order or good morals in connection with his/her stay.
(2) When it is recognized that the guest falls under any of the following items (a) through (c).
b. Boryokudan (organized crime groups), Boryokudan members, quasi-organized crime groups, or persons related to Boryokudan, and other antisocial forces
b. Boryokudan or a juridical person or other organization whose business activities are controlled by Boryokudan or Boryokudan-members
C. A juridical person of which any of its officers falls under the category of Bouryokudan-in (organized crime group) member
(3) When the guest has said or done something that causes significant inconvenience to other guests
(4) When it is clearly recognized that the lodger is a person with a contagious disease.
(5) When a violent demand is made with regard to the accommodation, or when a burden exceeding a reasonable range is demanded.
(6) When the hotel is unable to accommodate the guest due to force majeure such as natural disasters
(7) When a guest is drunken, etc., and is likely to cause serious inconvenience to other guests. (8) When a guest is extremely disturbing to other guests by his/her speech or behavior. (When a guest falls under the provisions of Article 10 of the Enforcement Ordinance of the Hyogo Prefecture Ryokan Law)
(8) When a guest does not comply with the prohibition of smoking in the bedroom, tampering with fire-fighting equipment, etc., or any other prohibited acts (limited to those necessary for fire prevention) in the rules of use established by the hotel. (9) When a guest does not comply with the rules of the hotel (limited to those necessary for fire prevention).
(2) When the accommodation contract is cancelled by the hotel pursuant to the preceding paragraph, the hotel will not charge the guest for accommodation services, etc. that have not yet been provided.
(Registration for lodging)

Guests are required to register the following items at the front desk of the hotel on the day of their stay.
(1) Name, age, sex, address and occupation of the guest
(2) In the case of a foreigner, nationality, passport number, place of entry and date of entry
(3) Date and scheduled time of departure
(4) Other matters deemed necessary by the hotel
When a guest intends to pay the charges as specified in Article 12 by a traveler's check, hotel voucher, credit card, or any other method that can be substituted for currency, the guest must present them in advance at the time of registration as specified in the preceding paragraph.
(Room usage time)

Guests may use their rooms from 3:30 p.m. to 11:00 a.m. the following morning. However, in the case of a consecutive stay, the guest may use the room for the entire day except for the first day of arrival and the day of departure.Notwithstanding the provisions of the preceding paragraph, the hotel may accept the use of a room outside the hours specified in the preceding paragraph. In such cases, the following additional charges shall apply
(1) 1/3 of the room charge (or 30% of the room charge) for up to 3 hours over the limit
(2) Up to 6 hours over the limit, 1/2 of the room charge (or 50% of the room charge)
(3) For more than 6 hours over 6 hours, the full amount of the room charge (or 100% of the amount equivalent to the room charge)
The amount equivalent to the room charge in the preceding paragraph shall be 70% of the basic room charge.

Guests shall follow the rules of use established by the hotel and posted in the hotel.(Hours of operation)
第11条
The hours of operation of the main facilities listed below are available in the service directory and other information.
(1) Front desk, etc.
(2) Food and beverage, etc.
(3) Incidental services
The hours in the preceding paragraph may be changed temporarily if necessary or unavoidable. In such cases, notification will be made by appropriate means.
(Payment of fees)

The breakdown of accommodation charges, etc. to be paid by the guest shall be as listed in Appended Table 1.2. Payment of the accommodation charge, etc. as set forth in the preceding paragraph shall be made at the front desk at the time of the guest's departure or when requested by the hotel, in currency or by a method acceptable to the hotel, such as a traveler's check, room voucher, or credit card, which can be substituted for currency.
The hotel will charge a room charge even if the guest voluntarily does not stay in the room after the hotel has provided the room to the guest and made it available for use.
(Responsibility of the Museum)

In the event that the hotel causes damage to a guest due to the performance or non-performance of the accommodation contract and related agreements, the hotel will compensate for such damage. However, this shall not apply if the damage is not caused by reasons attributable to the hotel.The hotel has Ryokan liability insurance to protect against fire, etc. in case of emergency.
(Treatment in the event that the contracted room cannot be provided)

If the hotel is unable to provide the guest with the contracted room, the hotel will, with the consent of the guest, mediate other accommodations under the same conditions as far as possible.If, notwithstanding the provisions of the preceding paragraph, the hotel is unable to arrange other accommodation, it will pay the guest a compensation fee equivalent to the amount of the penalty, and the compensation fee will be applied to the amount of compensation for damages. However, if there is no reason attributable to the hotel for not being able to provide the guest room, the hotel will not pay the compensation fee.
(Handling of Deposited Property, etc.)

In the event of loss, damage, etc. to articles left at the front desk by a guest, the hotel will compensate for such damage, except in cases where such damage is caused by force majeure. However, if the hotel requires the guest to disclose the type and value of the item and the guest fails to do so, the hotel will compensate for the damage up to 30,000 yen.The maximum value that can be deposited at the front desk is limited to 30,000 yen.
The hotel will compensate for any loss, damage, etc. caused by the intentional or negligent act of the hotel with regard to articles brought into the hotel by the guest and not left at the front desk. However, the hotel will compensate for damages up to 30,000 yen for items for which the type and value were not specified by the guest in advance, except in the case of willful misconduct or gross negligence on the part of the hotel.
(Storage of baggage or personal belongings of guests)

If a guest's baggage arrives at the hotel prior to his/her stay, the hotel will take responsibility for its safekeeping only if the hotel understands this prior to the arrival of the baggage, and hand it over to the guest when he/she checks in at the front desk.In the event that a guest's luggage or personal belongings are left at the hotel after the guest has checked out and the owner is found, the hotel shall contact the owner and request instructions from him or her. However, if the hotel does not receive instructions from the owner, or if the owner cannot be identified, the hotel will keep the property for 7 days from the date of discovery, after which the property will be destroyed.
3. in the case of the preceding two paragraphs, the responsibility of the hotel for the custody of the guest's baggage or personal belongings shall conform to the provisions of paragraph 1 of the preceding article in the case of paragraph 1, and to the provisions of paragraph 2 of the same article in the case of the preceding paragraph.
(Responsibility for parking)
第17条
When a guest uses the parking lot of the hotel, regardless of whether or not the guest has deposited the keys to the car, the hotel rents the parking lot to the guest and is not responsible for the management of the car. However, if the Museum intentionally or negligently causes damage in the management of the parking lot, the Museum will be held responsible for compensation.(Guest responsibility)
第18条
In the event that this hotel suffers damages due to the intentional or negligent act of a guest, said guest shall compensate this hotel for such damages.Appended Table 1 Breakdown of Accommodation Charges, etc. (Re: Article 2, Paragraph 1 and Article 12, Paragraph 1)

Remarks 1. Basic room charge is based on the tariff to be presented.
2 Children's rates apply to elementary school students and younger.
10 to 12 years old: 70% of the adult rate
6 to 9 years old: 50% of the adult rate
3 to 5 years old: 30% of the adult rate
0 to 2 years old: (infants not provided with bedding and meals): 10% of the adult rate.
